LEY NACIONAL DE RESPUESTA INTEGRAL AL VIH, HEPATITIS VIRALES, OTRAS INFECCIONES DE TRANSMISIÓN SEXUAL -ITS- Y TUBERCULOSIS –TBC. Decreto 804 y Decreto 805/2022. Apruébase la Reglamentación del Capítulo VII de la Ley N° 27.675. Apruébase la Reglamentación de la Ley N° 27.675.

El Decreto 804/22 – Modificatoria del Capítulo VII de la Ley 27675, reglamenta aspectos de la seguridad social solamente. Fundamentalmente condiciones de jubilación en caso de tener HIV / Hepatitis B y C.

Es relevante el Anexo del Decreto 805/22, Capítulo II de “Derechos y Garantías” y el Capítulo IV de “Diagnóstico”.

En el Capítulo II, se garantiza el trato digno, el consentimiento informado y la reserva en la información ante una persona afectada con HIV, Hepatitis, ETS y TBC.

El artículo 8 dispone que un establecimiento sea público o privado que realice exámenes médicos laborales, sean preocupacionales, periódicos o de otra índole para el trabajo, debe exponer un letrero que advierta “Se prohíbe la oferta y la realización de pruebas diagnósticas para HIV, Hepatitis virales, ETS y TBC, tanto al inicio como durante la relación laboral”. Cualquier afectado por algunas de estas patologías no pueden tener acciones restrictivas en el trabajo y se habilita la denuncia a la SRT.

Asimismo, se propicia generar capacitaciones sobre las patologías mencionadas en el ámbito laboral, donde la ART y la SRT deberán tomar acciones articuladas.

En el Capítulo IV de “Diagnóstico”, el artículo 14 y 15, determinan que las pruebas, bajo consentimiento, se realizarían según las “Guías Clínicas” actualizadas por MSAL y serán de cobertura obligatoria por PMO.
